Research in this book delves into the intricate mechanisms through which penal elitism operates. It explores how decision-making processes, such as arrests, prosecutions, and sentencing, can perpetuate inequalities and widen the gap between the privileged and the marginalized.

Examining Legitimacy in the Criminal Justice System

Legitimacy is a fundamental aspect of any criminal justice system. This book investigates the concept of legitimacy within the context of penal elitism. It scrutinizes the perception of fairness, consistency, and procedural justice among different social groups.

The authors present compelling evidence that public perceptions of legitimacy are shaped by personal experiences and perceptions of discrimination. They argue that addressing legitimacy concerns is crucial for maintaining social order and preventing the erosion of public trust in the justice system.

Understanding Citizenship and its Interplay

The concept of citizenship, often associated with national identity, is also explored in this research. The authors examine how citizenship is intertwined with penal elitism and legitimacy, highlighting the impact of criminal justice practices on individuals' sense of belonging and inclusion within society.

By analyzing the interplay between citizenship and the criminal justice system, the authors shed light on the mechanisms that either reinforce or challenge existing power dynamics. They emphasize the need for policies and practices that promote inclusive citizenship to dismantle the structures of penal elitism.

Looking Towards the Future

This book not only presents thought-provoking research on penal elitism, legitimacy, and citizenship but also offers recommendations for future reforms in the criminal justice system. It calls for a more comprehensive understanding of the societal implications of existing policies and practices to mitigate the perpetuation of penal elitism.

Moreover, the authors advocate for increased public engagement and participation in shaping criminal justice policies. By amplifying the voices of marginalized groups and incorporating diverse perspectives, they argue that a more inclusive and just system can be achieved.

"Penal Elitism Legitimacy And Citizenship" offers a comprehensive examination of the complex dynamics between penal elitism, legitimacy, and citizenship. It encourages readers to critically evaluate the existing criminal justice system and consider the potential for transformative change.

By drawing attention to these critical issues, the authors contribute to a broader understanding of how the justice system impacts individuals and society as a whole. This research serves as a catalyst for meaningful dialogue and calls for action to address the disparities and inequalities perpetuated by penal elitism.

As society progresses, it is crucial to continually reevaluate these concepts, question prevailing assumptions, and strive for a more equitable and inclusive criminal justice system.

A society’s response to youth crime reveals much about its broader cultural values, social circumstances, and political affairs. This book examines reactions and policy responses to youth delinquency and crime in Hong Kong during its colonial and post-colonial periods, and in doing so, underscores the history of Hong Kong itself and its present-day circumstances.

Exploring how officials have responded to youth crime in Hong Kong over time, this book tracks the emergence of a penal elitist mode of governance, highlighting concerns not only about young people’s behavior but the need for officials to establish state authority and promote citizen identification. In turn, it reveals an alternative to the ‘usual story’ about youth crime found in many western regions and provides an opportunity to begin to develop a comparative criminology. The book examines the emergence of the ‘disciplinary welfare’ tariff during the 1970s, debates and policy changes related to the minimum age of criminal responsibility and youth sex crimes, and inaction regarding the of restorative justice initiatives in the post-colonial era. It also addresses the power of ‘Post-80s’ youth to protest and challenge government policies, which directly combat contemporary fears regarding the ‘mainlandization’ of Hong Kong.

Drawing on archival sources, official reports and interviews with key stakeholders in the juvenile justice system, Responding to Youth Crime in Hong Kong will appeal to students and scholars interested in Chinese society, criminology, social work, sociology and youth studies.
